A. TRAFFIC
Q: I was given a traffic citation less than 30 days, can you go to court for me?

A: Yes, the attorney can go to court on your behalf.

Q: How much does your office charge to represent me?

A: $59 for regular moving violations and $69.00 for accident cases. For other type of traffic citations, contact our offices directly at (305) 443-1443, 24 hours a day 7 days a week.

Q: What happens if the citation was issued over 30 days ago?

A: There are basically two solutions: 1. For tickets 30-180 days late, it can be reset automatically. There is a $25.00 charge to reset the ticket. 2. For tickets over 180 days, a motion must be filed with the court, appear at a hearing, and request the judge to reset the ticket. There is a $50.00 charge to file the motion.

Q: If I hire you, will I know the date that the attorney has to go to court on my behalf?

A: Yes. The court sends us notification with the court date and they will send you a copy as well. There are basically two different hearings: First, is the pre-trial conference, and second, the trial setting. At the pre-trial conference, the police officer does not appear. The attorney will appear in order to dismiss or reach a favorable solution to your case. If your case is not resolved at the pre-trial hearing, then your case will be set for trial. A hearing date will be set by the clerk of court. At the trial, the police officer will appear. The attorney will appear in order to defend the citation. p

Q: Will I have to go to court with the attorney?

A: No, unless instructed otherwise by our office, or if you desire to appear.

Q: Will I get points on my Driver's license?

A: Our main goal and concern is to make sure that no points are assessed to your driver's license. However, WE CANNOT GUARANTEE that you will not receive points. To that end, several factors are crucial: Severity of infraction, driving history and ultimately, the decision of the judge.

Q: Will I have to pay anything else?

A: Possible, depending on the outcome of your case. If the ticket is dismissed, you do not have to pay anything else to the court. The only expense you will have is the attorney's fees (The ticket itself does not have to be paid). However, depending on the outcome of the ticket and your driving history, you may be assessed court cost, which have to be paid directly to the court.

Q: Will the attorney only go one time to court for this citation?

A: The attorney may need to go more than once, depending on the outcome of the first hearing date. The ticket may get resolved that day or we may have to set it for trial and get another day in court.

Q: Will you notify me of the outcome of my traffic citation?

A: Yes. Immediately after your court date, we will be mailing you the court disposition. In it, you will see the outcome of the ticket, whether it was dismissed or if you have to pay court cost and instructions from the court on how to pay the court cost. You may also check our website 2 days after your court date for the copy of the disposition. It is imperative that our office has your mailing address current to make sure the court disposition is delivered to you via mail.
